Samara Region Development Corporation took part in discussion of the projected federal law on private public partnership

Deputy General Director – head of the legal department of Corporation S.A. Goryachev and temporary acting Deputy General Director of Corporation A.V. Novikov took part in Duma hearings on the theme: “On the project of Federal law No. 23 8827-6 “On basics of private public partnership in the Russian Federation” that took place on June 5, 2013.

Minister of property relations of the Samara region Yuliya Stepnova, representatives of specialized ministries of the Samara region, Chamber of Commerce and Industry of the Samara region and other interested people took part in the event chaired by deputy Vyacheslav Pikalov.

An analysis of federal and regional legislations has shown that currently there is no possibility to implement the private public partnership projects in the forms that are used in the world’s practice. Statutory regulations stipulate using of concession agreements which significantly limits the investors’ possibilities to attract debt financing.

The project of federal law discussed by the participants of Duma hearings is aimed to remove the existing limitations and extend the possible forms of implementation of projects based on PPP principles. Goal of the project is to attract investments to the economy of the country as well as to improve quality and accessibility of services for citizens. The participants of Duma hearings also discussed provisions of projected law that are required legislative improvement.

Participant of the event were unanimous in their opinion that the projected federal law shall consider the risks of all parties of partnership. An issue on existing PPP projects administration was brought up. The representatives of the Corporation noticed the poor efficiency of the existing regional law on PPP and also expressed some suggestions on making amendments to considering project of federal law.
